Appointments may be rescheduled or canceled without charge 24 hours or more prior to the appointment start. Rescheduling and cancellations are the responsibility of the client and must be done through email or text. In the absence of 24 hours notice, canceled and rescheduled appointments for any reason will be subject to regular pricing charges. Tara Weaver Fitness, LLC reserves the right to cancel any further appointments for repeated last minute cancellations, no-shows or late arrivals.
Tara Weaver Fitness, LLC will provide advanced notice of any pricing or scheduling changes and reserves the right to change the price or schedule for any of their appointment types. The client must provide a valid credit or debit card to be vaulted on the Acuity website. Clients will be automatically billed for the past or future appointments, depending on the payment arrangement agreed upon. The client may request that a different card be charged, however the card on file may be charged in the event that another card or form of payment is not provided. Tara Weaver Fitness, LLC reserves to the right to cancel any future appointments at any time. A refund for any advance payment by the client will be issued if advance payment was made by the client.
This waiver and release agreement is intended to be as broad as is allowed under the applicable law and applies to any and all claims for damages, regardless of whether they are allegedly caused by the negligence of the trainer(s) or facility/club employees or owners. This waiver also recognizes that your trainer(s) will take steps to reduce the likelihood of injury as much as possible. This waiver and release agreement applies to all injuries including but not limited to, slipping in the facility or home, injuries caused by malfunctioning equipment, etc. This waiver applies regardless of whether you are using exercise equipment at the time of the injury or whether your injury occurs as a result of your presence upon the premises regardless of purpose or activity at the time of injury-causing incident. Client waives any claim of personal injury, including those arising out of negligence of this release and its owner. Client agrees and covenants not to sue or otherwise attempt to hold the trainer(s) or facility owner and employees liable for any injuries regardless of the cause, or due to negligence by the trainer(s).
Client assumes any and all risk or injury associated with or in any manner related to his or her use of or presence upon the facility, home or any location where the exercise routine is practiced. The client assumes any and all risks of injury associated with or in any manner related to his or her use of any exercise equipment (including, but not limited to, weights, resistance bands, TRX Suspension training systems, punching bags and gloves, yoga equipment, etc.) located in the facility, home or location where the exercise routine is practiced.
Your trainer(s) recommend(s) you seek the advice of your physician before commencing any exercise routine. This waiver and release agreement releases the trainer(s) from liability relating to any injuries resulting from the inherent risk of exercise activity, strength training, aerobic conditioning, stretching, or other forms of physical activity. There is a risk of certain changes that might occur during or following exercise, such as, abnormalities of blood pressure or heart rate, acute muscle and/or joint pain, pulled muscles, light headedness, dizziness, delayed onset muscle soreness (DOMS), and more chronic conditions, such as tendonitis, and other discomforts. Any type of physical activity may in rare cases lead to heart attack, stroke or death, but this is unusual.
This waiver agreement releases the trainer(s) from liability for the informed treatment risks of a treatment or program to which the client agrees to (e.g. online training program, assisted stretching including “PNF” or proprioceptive neuromuscular facilitation, kickboxing/martial arts/boxing instruction, suspension training, remote fitness programming, etc.).
I agree to voluntarily participate in any exercise program. I understand that I am free to deny consent if I so desire now or at any point in the program.
To promote the safety and benefit of my participation in any and all exercise routines, it is important that I fully disclose my personal health history, any medication I am taking and any symptoms I may be experiencing during exercise. Such symptoms would include joint pain, irregular heart rhythm, tightness or pressure in my chest, unusual shortness of breath, light headedness, dizziness and the like. It is also important that I adhere to the recommendations of the trainer(s) especially with regard to the choice and intensity of exercises I perform. I understand that my trainer may refer me to a licensed medical professional or therapist if my symptoms become chronic or severe and that it is my responsibility to obtain advice, clearance and/or a diagnosis from a medical professional before continuing my program with my trainer. This may require direct communication between your doctor/therapist and trainer.
